Democrat Congresswoman ARRAIGNED on Assault Charges

Wooden gavel and handcuffs on a table.

A U.S. Democrat Congresswoman stands at the center of a legal and political storm following an incident in a detention center used by ICE, where she assaulted an agent.

Democrat Congresswoman LaMonica McIver (D-NJ) faces serious federal charges for allegedly assaulting immigration officers during what was supposed to be a routine oversight visit.

The New Jersey representative’s violent confrontation with ICE agents at a detention facility has resulted in charges that could land her in prison for up to eight years.

This exposes yet another example of Democrat officials interfering with immigration enforcement.

The 39-year-old representative was arraigned today for an incident that occurred on May 9, 2025, at Delaney Hall in Newark, a privately owned detention center used by Immigration and Customs Enforcement.

According to the indictment, the McIver “slammed” her forearm into an ICE agent and attempted to physically prevent officers from arresting Newark Mayor Ras Baraka during their visit to the facility.

Interim U.S. Attorney Alina Habba, a GOP appointee of President Donald Trump, filed the charges.

This highlights the growing conflict between the Trump administration’s efforts to enforce immigration laws and Democrats’ attempts to obstruct those policies.

McIver has been indicted on three separate counts, two of which carry maximum sentences of up to eight years in prison and the third of which carries a maximum of one year.

The complaint details how McIver not only assaulted an agent but also attempted to restrain him during the confrontation.

Later, when Mayor Baraka was being arrested on trespassing charges (which were subsequently dropped), McIver reportedly wrapped her arms around him to prevent the arrest and again “slammed” her forearm into an agent.

The Homeland Security Department released video footage of the confrontation, though Democrats are predictably disputing the interpretation of McIver’s actions.

Paul Fishman, McIver’s lawyer and a former U.S. Attorney for New Jersey, stated she would challenge the allegations “head-on.”

This case represents a rare and serious development as it involves a sitting member of Congress facing charges unrelated to the usual Democrat corruption scandals.

It also underscores the lengths to which some Democrat officials will go to interfere with immigration enforcement agents who are doing their jobs protecting American borders and communities.

Predictably, Democrats asserted that members of Congress have legal authority to enter federal immigration facilities for oversight purposes without prior notice (per a 2019 appropriations bill).

Still, this authority does not grant them the right to obstruct or assault federal officers carrying out their duties physically.

The law applies equally to everyone, even members of Congress who believe they are above it.

Mayor Baraka, who was arrested during the same incident, is now suing Habba for malicious prosecution after his trespassing charge was dropped.

This retaliatory legal action is typical of how Democrats respond when held accountable for their actions – they deflect responsibility and attack those enforcing the law.

McIver was elected to Congress in a special election following the death of Congressman Donald Payne Jr. and subsequently won a full term.

She previously was the president of the Newark City Council and worked in the city’s public schools.

If convicted, this rising Democrat star could see her political career come to an abrupt end.
