Federal Judge Halts Trump’s Government Downsizing Initiative

U.S. District Judge Susan Yvonne Illston issued a temporary restraining order on October 15, 2025, blocking the Trump administration from proceeding with reduction-in-force notifications sent to more than 4,000 federal employees.

The order applies to workers represented by the American Federation of Government Employees and the American Federation of State, County and Municipal Employees. Illston scheduled a hearing for October 28 to consider a preliminary injunction that would extend the protection.

President Trump openly acknowledged using the government shutdown as an opportunity to permanently eliminate federal positions within agencies he considers politically motivated.

Trump posted on social media that he was meeting with Budget Director Russell Vought to determine which “Democrat Agencies, most of which are a political SCAM” should face cuts.

Vought appeared on “The Charlie Kirk Show,” indicating that “north of 10,000” federal jobs would be eliminated during the shutdown.

Legal Challenge Centers on Constitutional Authority

Judge Illston characterized the administration’s actions as “unprecedented” and “contrary to the laws,” stating that firing civilian employees during a shutdown to punish the opposing political party violates established legal frameworks.

The judge argued that the administration assumed “all bets are off” during the funding lapse and believed they could ignore existing statutes. Democracy Forward, representing the unions, claimed the targeting of federal workers follows Project 2025’s blueprint for government restructuring.

Government Shutdown Continues Despite Multiple Senate Attempts

The restraining order came on the 15th day of the government shutdown, coinciding with the Senate’s ninth rejection of a stopgap funding bill.

The extended shutdown has provided the Trump administration with what the president called an “unprecedented opportunity” to restructure federal agencies.

The administration maintains that eliminating positions within agencies they view as politically motivated represents necessary government efficiency rather than partisan retaliation.
