The Supreme Court rejected an appeal from a Massachusetts student, Liam Morrison, barred from wearing a T-shirt stating “There are only two genders.”
This decision supports a lower court ruling siding with Middleborough, Massachusetts educators, who argued that the shirt could negatively impact transgender and gender-nonconforming students.
The case began in 2023 when Liam, a seventh-grader, was sent home for refusing to change shirts with messages “There are only two genders” and “There are [censored] genders.”
His father and stepmother, Christopher and Susan Morrison, argued that Nichols Middle School violated his free speech rights.
School officials claimed the shirts made classmates feel unsafe, and a federal court agreed, stating the message was demeaning to transgender students.
A federal appeals court upheld this decision, supporting the school’s actions due to concerns about disrupting the educational environment.
Justices Samuel Alito and Clarence Thomas dissented, emphasizing the importance of whether public schools can suppress student speech based on disfavored viewpoints.
Alito noted the school allowed expressions supporting multiple genders but censored the opposing view.
He criticized the appeals court for deferring to school officials without concrete evidence of disruption, arguing discomfort or unpleasantness shouldn’t suppress free speech.
The First Circuit Court of Appeals justified its ruling by referencing the 1969 Supreme Court decision in Tinker v. Des Moines, permitting student protests if they don’t substantially disrupt education.
However, Alito insisted that free speech should be the norm, even if schools find the message undesirable.
Despite these arguments, the Massachusetts school district asserts the ruling supports protecting students’ mental health and maintaining a secure environment.
This case underlines ongoing tensions surrounding transgender rights and free expression in schools, following the contentious policies introduced by former President Donald Trump that only recognized two sexes.
“I’m just voicing my opinion about a statement that I believe to be true,” Liam Morrison has said, cited by Fox News.
As the battle for conservative values continues, questions about government overreach and the infringement of free speech rights for students remain at the forefront.
