Specifically, Hunter Biden’s chief criminal defense lawyer, Christopher Clark, has requested a federal judge’s approval to exit the case, indicating he may be summoned as a witness in upcoming proceedings.

Christopher Clark, who has long represented Biden, submitted his request to a Delaware judge in charge of the case since the announcement of a plea agreement in June.

“Based on recent developments, it appears that the negotiation and drafting of the plea agreement and diversion agreement will be contested, and Mr. Clark is a percipient witness to those issues,” read a statement from Biden’s legal team.

Concerning tax offenses, federal prosecutors expressed last week that they hit a stalemate concerning the plea deal and a connected “diversion agreement” meant to settle a gun possession charge. Consequently, they sought the judge’s consent to remove a late August deadline she set for both parties to rework the deals. This came after her decision not to endorse them during a prior hearing.

On Sunday, Biden’s attorneys expressed their view that the agreement related to the gun diversion remained “valid and binding.” Abbe Lowell, one of the representing lawyers, pointed fingers at the prosecutors, attributing the problematic aspects of the agreements that the judge disagreed with to them.

Currently, the judge is awaiting more details and has yet to decide on the case’s progression.

Amid the breakdown of plea negotiations last week, the case’s prosecutor, US attorney David Weiss, was awarded the “special counsel” designation by Attorney General Merrick Garland.
