
(GoRealNewsNow.com) – Montana Republicans are fighting to protect gun rights from the growing threat of red flag laws, with State Representative Braxton Mitchell at the helm.
The lawmaker has introduced House Bill 809, which would prevent local governments from adopting measures to seize guns from citizens who have not committed any crime.
The initiative represents a bold stand for constitutional rights in an era when gun ownership faces mounting attacks.
Mitchell is leading the charge against so-called “Extreme Risk Protection Orders” (ERPOs) that have been implemented in numerous liberal-controlled states across America.
House Bill 809 would preemptively block any Montana locality from adopting these controversial measures.
ERPOs allow courts to order the confiscation of firearms from individuals deemed “potentially dangerous” without a criminal conviction.
Mitchell’s legislation takes a firm stance on constitutional rights, prohibiting local governments from enacting or enforcing these measures.
The bill also forbids localities from accepting funding intended for implementing such orders.
Government officials who violate the proposed law could face civil penalties up to $10,000, ensuring serious consequences for those who attempt to infringe on Montanans’ Second Amendment rights.
The legislation specifically identifies red flag laws as violations of the Second Amendment of the U.S. Constitution and Montana’s constitutional protections for gun ownership.
Unlike many blue states where gun rights are constantly under assault, Montana is taking proactive steps to safeguard citizens’ liberties.
“The bottom line, you cannot strip constitutional rights based on accusations alone. If someone is truly dangerous, they should be charged, tried and convicted, not disarmed through judicial tyranny,” stated Mitchell.
Predictably, liberal groups like the Montana Domestic and Sexual Violence Coalition and Everytown for Gun Safety oppose the measure.
Everytown claims that “a multistate study found that one suicide was averted for every 17 ERPOs issued” but conveniently ignores the constitutional violations in these laws.
What gun-grabbing organizations fail to acknowledge is that red flag laws have proven ineffective in the states where they have been implemented.
California, which pioneered red flag laws in 2014, continues to lead the nation in active shooter incidents.
According to Liberty Park Press, 16 out of 17 red flag cases fail to prevent the harm they claim to address.
The Second Amendment Foundation has recognized the threat posed by these laws.
In response, it has launched its “Capture the Flag” program to challenge red flag laws in multiple states.
Montana’s effort represents part of a growing movement to resist unconstitutional gun control measures pushed by Democrat-controlled states.
